Terms and Conditions for Your Perfect Smile by CIT


These terms and conditions govern your relationship with Us namely Cosmetics In Turkey Ltd T/A Your Perfect Smile, Trust House, 5 New Augustus Street, Bradford, BD1 5LL. (Company registration number: 15011568) Any information and services provided are conditional upon your acceptance, without modification and your use of the www.yourperfectsmiles.com website constitutes agreement with such terms.


ACCEPTANCE OF TERMS
The information and services set out in these terms and conditions are conditional upon your acceptance, without modification and your use of the http://www.yourperfectsmiles.com website is deemed by law to be an agreement with such terms. Cosmetics In Turkey Ltd T/A Your Perfect Smile reserves the right, at our sole discretion, to change, modify, add or remove temporarily or permanently any of these terms and conditions. We shall not be liable to any user or third party for any reason for such modification, suspension or discontinuance.


1. DEFINITIONS
“Agreement” – This Agreement as set out in the Terms and Conditions.
“Terms and Conditions” - -The Terms and Conditions of the Agreement.
“List” – A Document outlining the details of the specific Treatment Package you intend to purchase.
“We”/ ”Us” – Cosmetics In Turkey Ltd T/A Your Perfect Smile registered at Trust House, 5 New Augustus Street, Bradford, BD1 5LL (Company registration number: 15011568).
“Trading name” – Your Perfect Smile.
“Service Provider” – The hospital, private clinic or any other dental or medical professional providing your consultations, examination, dental procedure and aftercare in the Destination.
“Destination” – The location you will be travelling for the Treatment Package.
“Treatment Package” – All or some of the dental treatment, accommodation, private transfers and consultations you have chosen to purchase through our agency with your Service Providers but not including all or any travel cost to or from the Destination.
“Procedure” – The Treatment Package you have chosen to undertake.
“You” – The Customer/Client.


2. PAYMENT
2.1 All prices will be given in GBP (pound sterling).
2.2 Depending on your choice, your Treatment Package price will normally include the costs of one or more of the following as detailed on our cost quotation for the Treatment Package:
a) Surgery/Dental treatment.
b) Accommodation.
c) Private transfers at the Destination.
d) Consultation(s).
e) Any pre-operative or pre-treatment tests you are advised to take by the Dental/Medical personnel at the Destination.
2.3 Any additional dental/medical services at the Destination beyond the Treatment Package are not included and are a matter for you and the Service Provider concerned.
2.4 You will incur additional charges for any other tests considered necessary because of any pre-existing or other medical condition or your exposure or vulnerability to any condition.
2.5 Once you have accepted the cost quotation provided to you with a link to these Terms and Conditions, you will be required to pay a minimum 20% deposit to us. You may pay your deposit via bank transfer, credit/debit card or cash. Your deposit is non-refundable in any event.
2.6 The remainder of your balance, which is the package price minus the deposit, must be paid prior to your departure from your home to the Destination. Obtaining the full payment does not hold us liable for the services provided by the Service Provider. We act as a booking agent but not as a Service Provider in any event.
2.7 If the remainder of your balance is not paid before the Treatment is due to be carried out by the Service Provider at the Destination, you will be in breach of the terms of this Agreement and neither Us nor any Service Provider is obliged to deliver the Treatment Package without such payment in full.
2.8 Your Treatment Package may include stay in the hospital at the Destination or elsewhere. In cases where you stay more than one night, additional nights will be charged to you direct by the hospital at the current rates of the hospital for private patients.


3. YOUR TREATMENT
3.1 LIMITATION OF LIABILITY. We do not provide any dental nor medical advice nor do we operate or control any Service Provider facility or service rendered by them. Your treatment forms and prompts a contractual relationship direct between you and the actual Service Provider providing the treatment. We do not hold medical qualifications and shall not be held responsible or liable for any medical or dental procedures provided through your chosen Service Provider. We shall not be responsible or liable for any care, treatment or other services provided with by the same, or for any malpractice claims that may arise directly or indirectly from their advice or treatment. Similarly, we do not have responsibility or liability for any complications and/or dissatisfactions arising from the Service Provider’s treatment. Our role is as an agent to solely facilitate a consultation and/or dialogue between you and your chosen Service Provider. We strongly recommend that you read the Service Provider’s own terms and conditions and medical consent forms carefully prior to proceeding with your treatment(s). You must make your own judgement as to the Treatment Package and Service Provider as we act only to facilitate your Treatment Package with the Service Provider but not to carry out any part thereof.
3.2 The Treatment Package suggested by us as a result of email exchanges, telephone conversations or consultations with you are purely based on the information you provide (i.e. the pictures, test result, prescriptions, x-rays, etc.) and as reviewed by the Service Provider. Therefore, your Treatment Package may materially change when the Service Provider examines you in person before your Procedure.
3.3 If such a material change occurs, you have the option not to go ahead with the Treatment Package. In such circumstances you will receive a refund after proper and reasonable cost deductions. Any accommodation, travel and transfer costs incurred will not be reimbursed.
3.4 If you wish to proceed with the new Treatment Package then will you will receive a revised cost quotation and the balance to the Service Provider will be adjusted based on the initial payments already made. The length of the stay at the Destination will be factored in if the Treatment Package changes. Your duration of stay may also change we take no responsibility for any reason including alteration to the Treatment Package and any alteration to your stay at the Destination.
3.5 You agree not to hold Us responsible for dental and/or medical negligence or malpractice by your chosen Service Provider. If you are in the unfortunate position of needing to bring a claim for such negligence then you agree the appropriate defendant is the Service Provider concerned and no other party.
3.6 Non-Disparagement. You agree not to publish any material relative to us and/or the Treatment Package on any Social Media or other Media at all without our express consent in writing. You agree to raise any complaint after treatment direct with the Service Provider and not Us.
3.7 We are not responsible for the Treatment Package carried out by the Service Provider nor the services, medical/dental treatments and procedures provided by them. You agree not to publish any adverse comment relating to us without having first fully and effectually raised your complaint and/or grievance in writing with us. We undertake to interact with any such complaint or grievance fairly and reasonably but will not have any obligation to do so if you publish any material with any third party by any means without full prior engagement with Us.


4. OUR RESPONSIBILITIES
4.1 As part of our Agreement with you, we will provide you with Lists containing the following information;
a) Detailed information about your Treatment Package.
b) Details about the cost of the Treatment Package you have chosen.
c) Information about any health requirements for the journey and your stay at the Destination especially in context of Covid-19 as far as we are able to provide information.
d) Information about any visa and passport requirements (which can be found on www.evisa.gov.tr/en)
4.2 Before you travel, we will provide you with all your travel details in good time and this will include;
a) The times and places of intermediate stops and transport connections (if relevant to your Treatment Package).
b) The name, address and telephone number of your Service Provider or of any agency at the Destination.
4.3 We do not operate nor control the services offered by the Service Provider nor hotel, travel or transfer companies. You agree that use of third party providers is without liability to us. Under no circumstances are we liable for any damages arising from any dealings between you and any third party healthcare, accommodation, travel or other transfer providers. Before booking any third party service you must check their terms and conditions.
4.4 If we have to cancel or change the booking, we will contact you. In such circumstances, you can choose to rearrange your Treatment Package or cancel your booking and receive a refund calculated on a scale dependent on timing of such change. See our Cancellation Policy. However, we are not responsible for any losses or expenses you suffer because of circumstances beyond our control. Circumstances beyond our control or force majeure including but not limited to the following:
a) Flight delays or cancellations.
b) Terrorist activity, war.
c) Civil unrest, strike, pandemic.
d) Bad weather such as flooding, hurricane, etc.
e) Earthquake.
f) Other event categorised normally as being force majeure.
4.5 The List will form part of this contract and should be read in conjunction with this Agreement.
4.6 For avoidance of doubt we are a booking agency and not a Service Provider. We do not accept any liability for any act or omission by the Service Provider or any other third party involved in the provision of the Treatment Package howsoever arising.


5. YOUR RESPONSIBILITIES
5.1 Perusal of our literature
You will peruse the literature made available to you, including information contained on your website in connection with matters set out at paragraph 4.1 before you accept this Agreement. By accepting this Agreement you accept and agree that you have read and understood the information made available to you.
5.2 Travel information, passports, Visas and documentation
You are solely responsible for ensuring you have the following:
a) A valid, acceptable passport.
b) A visa, if necessary.
c) Other travel documentation if necessary.
5.3 You are responsible for submitting in advance of travel, passenger information to your airline.
5.4 You must meet the entry requirements for both your Destination and any transit locations.
5.5 You accept that in the event of your failure to satisfy the requirements of paragraph 5.1, 5.2 and 5.3 or the information or documents provided by you being incorrect, you may be refused carriage and entry to the country you are visiting. You accept and acknowledge that in the event of this eventually you will be solely responsible for all resultant losses and We do not accept any responsibility nor liability for any such losses.
5.6 You are solely responsible for any fines or costs (including the costs of an immediate return flight) you accrue because of your failure to travel with the required passport, visa or other documentation. We accept no liability in this situation and no compensation, expenses, refund or other sum will be paid.
5.7 We do not accept responsibility for you missing any transport to your Destination for any reason. You are responsible for providing all necessary documents, including passports and visas in order to travel.
5.8 Health precautions
You should seek advance advice from your local GP. You will obtain health advice about your specific personal health needs or any required or recommended vaccinations for travel to your Destination. This information can be obtained from, among others, the following websites:

5.9 Insurance
It is a condition of you purchasing a Treatment Package from us that you will take out insurance with an approved travel and medical insurer. This is required to indemnify you of any losses suffered because of insolvency, travel problems or dental/medical issues. Non compliance is a breach of your Agreement with Us.


6. YOUR MEDICAL HISTORY AND RECORDS
6.1 Before your journey begins you must submit details of your medical history via us to your chosen Service Provider at the Destination. This is partly to ensure your suitability for the planned surgery. By accepting these Terms and Conditions, you agree to our sharing the details of your medical history, including your pictures, test results, prescriptions, x-rays, etc. with your Service Provider. We are not liable if the dental/medical history form has not been completed thoroughly or honestly or if any information is withheld nor if any advice from the Service Provider or your own health professional is not followed.
6.2 You permit us to obtain your patient file (including your treatment package, examination and treatment results along with before and after pictures) form the Service Provider for our internal records. No records sent to us will be transferred to any third party without your expressed consent at any time.


7. CANCELLATIONS
7.1 You may at any time cancel your booking up to 7 days prior to your treatment date by notifying us in writing. The cancellation will take effect from the day on which we receive written notification of your cancellation. The scale of charges payable will depend upon when the notification of cancellation is received. However, the cancellation charge will always be limited to actual expenses incurred and disbursements made, reserving the provision of the paragraph 4.4. In the event of a cancellation, your deposit will be kept as a reservation fee to cover our reasonable expenses incurred prior to cancellation. You may be liable to cancellation fees by the Service Provider as well.
7.2 Once the deposit is paid that will be the commencing of Our services to you. You will have a 14 days cooling-off period from this date.


8. DATA PROTECTION
8.1 We will hold your details, including your medical records in the strictest of confidence. We will not disclose your data records or information without your consent and will only share it with those concerned with your treatment.


9. PRIVACY STATEMENT
9.1 To ensure your privacy all patient information is held by the Service Provider in compliance with local laws and regulations. Photo images can be used for demonstrative purposes only to show possible results from Treatment Packages. We hereby undertake that images will not be retouched or enhanced in any way to change the appearance of procedure or treatment. We will not sell or rent your personal information to third parties. You consent to probable use of your before and after pictures by us in order to operate and improve our site for purposes of demonstration to potential customers and to perform research and analysis aimed at improving our products, services and technologies, and to display content that is customised to your interest and preferences.


10. APPLICABLE LAW AND JURISDICTION
10.1 This Agreement is governed by the law of England and Wales and is subject to the jurisdiction of the courts of England and Wales.
